David Gu

David Gu is the Principal Lawyer and Founder of ProActive Legal. With extensive experience in Australian immigration law, David is recognised as an Accredited Specialist in Immigration Law by the Law Society of NSW and is also a Notary Public. David’s career in immigration law began in 2005 at the Migration Review Tribunal and Refugee Review Tribunal (now part of the Administrative Appeals Tribunal). Later that year, he joined the Department of Immigration and Citizenship (currently the Department of Home Affairs), where he worked for over four years in various capacities, including assessing visa and citizenship applications and providing internal legal advice as a Legal Officer. In 2010, David joined a respected law firm renowned for its expertise in immigration law, progressing from Solicitor to Associate. In 2013, David established ProActive Legal with a commitment to delivering strategic and effective immigration solutions. He has extensive experience in judicial review matters and has successfully represented numerous clients in court as a solicitor-advocate. David’s advocacy skills and deep understanding of immigration law have enabled him to frequently resolve cases without the need for hearings. Notably, he has successfully challenged visa cancellation decisions made at airports by the Department of Immigration and Border Protection, resulting in favourable outcomes before court proceedings commenced. One significant case in his career was Singh v MIAC [2012] FMCA 145, which remains widely cited in the migration profession. Over the years, David has led his team in assisting countless clients with complex and challenging immigration matters. His thorough knowledge of immigration laws, policies, and processes allows him to identify practical and effective solutions where others may not. David is often referred clients through other migration professionals, who place great trust in his expertise.
